These Terms & Conditions (“Terms”) govern your access to and use of the websites, online stores, ordering platforms, products, services, and other online experiences operated by or on behalf of The Green Fork, LLC, d/b/a Green Fork & Straw (“Green Fork & Straw,” “The Green Fork, LLC,” “we,” “us,” or “our”).
These Terms apply to your use of greenforkandstraw.com, greenforkorders.com, and other Green Fork & Straw websites, online ordering experiences, and services that link to or reference these Terms (collectively, the “Services”).
Please read these Terms carefully. By accessing or using our Services, placing an order, or purchasing products through our Services, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree with these Terms, please do not use the Services.
1. ABOUT GREEN FORK & STRAW
Green Fork & Straw provides prepared foods, beverages, meal-prep products, Weeknight Meals, catering, cleanses, retail products, and related food and beverage services.
Products and services may be available for:

Pickup
Local delivery
Advance ordering
Catering
Special events
Holiday menus
Third-party delivery or ordering
Online purchase
Product availability, menus, pricing, pickup times, delivery areas, ordering deadlines, and other details may vary by location and may change from time to time.
2. ELIGIBILITY TO USE THE SERVICES
By using our Services or placing an order, you represent that you are legally capable of entering into a binding agreement.
If you are under the age of majority where you live, you may use the Services only with the involvement and permission of a parent or legal guardian.
You are responsible for ensuring that information you provide when using the Services is complete and accurate.
3. ONLINE ORDERS
When you submit an order, you are making an offer to purchase the products listed in that order.
Receipt of an order confirmation does not necessarily constitute final acceptance of an order.
We reserve the right to accept, reject, modify, or cancel an order when reasonably necessary, including because of:
Product unavailability
Ingredient shortages
Pricing or description errors
Suspected fraud
Payment issues
Technical errors
Weather
Operational limitations
Delivery limitations
Circumstances outside our reasonable control
If we cancel an order after payment has been successfully processed, we will provide an appropriate refund for the canceled portion of the order.
4. THIRD-PARTY ORDERING PLATFORMS
Green Fork & Straw may use third-party platforms to facilitate ordering, payments, catering, delivery, or other Services.
These may include platforms such as:
Shopify
ChowNow
BentoBox
Square
Delivery providers
Payment processors
Other third-party ordering or technology providers
When you use a third-party platform, your transaction or use of that platform may also be subject to the third party's own terms, policies, fees, and privacy practices.
Green Fork & Straw is not responsible for the independent acts, omissions, website availability, data practices, or technical performance of third-party platforms, except to the extent required by applicable law.
If there is a conflict between these Terms and terms presented specifically in connection with an order through a third-party platform, the terms specifically governing that transaction may control with respect to that platform or transaction.
5. PRICES AND PAYMENT
All prices are displayed in U.S. dollars unless otherwise stated.
Prices, menu items, serving sizes, availability, delivery charges, service charges, taxes, and other fees are subject to change.
The price and applicable charges displayed when you complete your order will generally govern that transaction.
Applicable sales taxes, delivery fees, service fees, gratuities, or other charges may be added to your order where applicable and will be disclosed during the ordering or checkout process.
You authorize us and our payment providers to charge the payment method you provide for the total amount shown at checkout.
We reserve the right to correct pricing errors.
If a product is mistakenly listed at an incorrect price, we may cancel the affected item or order and provide a refund of amounts paid for the canceled item.
6. PRODUCT AVAILABILITY AND SUBSTITUTIONS
Our products are prepared using fresh ingredients, and availability may vary.
Menu items, ingredients, garnishes, sizes, packaging, or presentation may occasionally differ from photographs or descriptions.
If an ingredient or item becomes unavailable, we may contact you regarding an appropriate substitution.
For minor components that do not materially change the nature of the product, we may make reasonable substitutions when appropriate.
We will not knowingly make a substitution that conflicts with an allergy or dietary restriction you have specifically communicated to us.
If a suitable substitution cannot be made, we may remove the affected item and issue an appropriate refund.
7. PICKUP ORDERS
Customers are responsible for picking up orders from the location, date, and time selected or stated when ordering.
Please verify your selected pickup location and pickup date before completing an order.
Because many Green Fork & Straw products are perishable and prepared specifically for scheduled pickup, orders that are not picked up may not be eligible for a refund.
If you believe you selected the wrong location or pickup date, please contact us as soon as possible. We will make reasonable efforts to assist, but changes cannot always be accommodated after preparation has begun.
Green Fork & Straw is not responsible for deterioration, spoilage, or food-safety issues resulting from an order being left unrefrigerated or uncollected after its scheduled pickup period.
8. DELIVERY ORDERS
Delivery availability depends on the delivery address, location, order type, and delivery provider.
Delivery estimates are estimates and are not guaranteed.
Delays may occur because of:
Traffic
Weather
Road conditions
Driver availability
Incorrect delivery information
Building access
Events
Circumstances outside our reasonable control
You are responsible for providing a complete and accurate delivery address, telephone number, access instructions, and other information reasonably necessary to complete delivery.
If a delivery cannot be completed because the information provided was incorrect or incomplete, or because no one is available to receive an order when necessary, the order may not be refundable.
Once a delivery has been properly completed at the address or location you specified, responsibility for promptly retrieving, refrigerating, storing, and handling the food transfers to you.
Orders delivered through an independent third-party delivery provider may also be subject to that provider's policies.
9. WEEKNIGHT MEALS, ADVANCE ORDERS, AND SPECIAL MENUS
Certain products are prepared specifically for customers who order in advance.
This may include:
Weeknight Meals
Holiday menus
Special event menus
Limited-release menus
Meal packages
Advance catering orders
These products may have specific:
Ordering deadlines
Pickup dates
Delivery dates
Locations
Quantities
Modification deadlines
Cancellation policies
The terms displayed on the applicable menu, product page, checkout page, order confirmation, or promotional material are incorporated into these Terms for that particular order.
Because food may be purchased, scheduled, or prepared based on advance orders, changes or cancellations requested after an applicable cutoff may not be possible.
10. CATERING
Catering orders may be subject to additional requirements disclosed in a catering proposal, ordering platform, invoice, confirmation, or other agreement.
These may include:
Minimum order amounts
Advance notice requirements
Delivery fees
Setup fees
Staffing fees
Deposits
Final payment deadlines
Guest-count deadlines
Modification deadlines
Cancellation deadlines
If specific catering terms are provided with your order, those terms are incorporated into and form part of these Terms.
You are responsible for reviewing all event information before approving or paying for a catering order, including the:
Event date
Event time
Delivery or pickup location
Menu
Quantities
Guest count
Dietary instructions
Changes requested after food has been purchased or preparation has begun may result in additional charges or may not be possible.
11. CANCELLATIONS, REFUNDS, AND ORDER ISSUES
Due to the perishable and made-to-order nature of many of our products, food purchases are generally not returnable.
Cancellation and refund eligibility may depend on:
The type of order
When the cancellation is requested
Whether preparation has begun
Whether ingredients have been purchased specifically for the order
Whether the product has already been picked up or delivered
The policies disclosed for a particular menu, catering order, promotion, or third-party platform
If you need to cancel or change an order, please contact us as soon as possible.
Once an ordering cutoff has passed or preparation has begun, we may be unable to cancel, modify, or refund the order.
Problems With an Order
We want to know if something is wrong with your order.
If an item is:
Missing
Incorrect
Damaged
Spoiled
Otherwise materially different from what you ordered
please contact us promptly after pickup or delivery.
Depending on the circumstances, we may provide an appropriate:
Replacement
Refund
Partial refund
Store credit
Other reasonable resolution
Any remedy will be determined based on the circumstances and applicable law.
Nothing in these Terms limits any refund, cancellation, or other consumer right that cannot legally be waived.
12. FOOD ALLERGIES AND DIETARY REQUIREMENTS
Green Fork & Straw provides information about ingredients and dietary characteristics to help customers make informed decisions.
Customers with food allergies, sensitivities, medical dietary restrictions, or other serious dietary concerns should review available ingredient information and communicate their concerns to us before ordering.
Certain products may contain or come into contact with common allergens, including but not limited to:
Milk
Eggs
Fish
Shellfish
Tree nuts
Peanuts
Soy
Sesame
Ingredients obtained from outside suppliers may also be manufactured or processed in facilities that handle allergens.
Although we take dietary requests and allergen concerns seriously, we cannot guarantee that every product will be free from every allergen unless we expressly state otherwise.
If you have a severe or life-threatening food allergy, please contact the applicable Green Fork & Straw location before ordering so that you can determine whether a particular product is appropriate for you.
13. GLUTEN-FREE PRODUCTS
Green Fork & Straw operates as a gluten-free food business and identifies its prepared menu items as gluten-free.
Ingredient information is provided to help customers evaluate products based on their individual needs.
However, customers with celiac disease, allergies, or serious sensitivities should make purchasing decisions based on their individual medical needs and should contact us with questions about particular ingredients or preparation practices.
Third-party packaged products sold by Green Fork & Straw are manufactured by their respective manufacturers, and representations regarding those products are based on information provided by those manufacturers.

15. FOOD HANDLING AND STORAGE
Many Green Fork & Straw products are perishable.
Customers are responsible for following any storage, refrigeration, reheating, use-by, or preparation instructions provided with a product.
Unless otherwise instructed, perishable foods should be refrigerated promptly after pickup or delivery.
We are not responsible for product quality or safety problems caused by improper transportation, storage, refrigeration, reheating, or handling after an order has been properly picked up or delivered.
16. PRODUCT DESCRIPTIONS AND PHOTOGRAPHS
We make reasonable efforts to accurately describe and display our products.
However:

Ingredients may be seasonal
Colors may display differently on different devices
Portion appearance may vary
Packaging may change
We do not guarantee that every photograph or description will be identical to the product you receive.
Material ingredient or allergen information should take precedence over photographs.
17. PROMOTIONS, DISCOUNTS, AND PROMOTIONAL CODES
From time to time, we may offer:

Loyalty benefits
Limited-time promotions
Additional terms may apply to a particular promotion.
Unless otherwise stated:
Promotions have no cash value
Promotional offers cannot be combined
Promotional codes must be used before their expiration date

Discounts cannot be applied retroactively after a transaction has been completed
We reserve the right to modify or end promotions where permitted by law.
We may reject use of a promotional offer in cases of suspected fraud, abuse, duplication, or violation of the promotion's terms.
18. GIFT CARDS
If Green Fork & Straw offers gift cards, additional terms presented at purchase may apply.
Gift cards may be subject to applicable federal and state laws regarding expiration dates, fees, refunds, and unclaimed property.
Gift cards are not redeemable for cash except where required by law.
Please protect gift card numbers as you would cash. Green Fork & Straw is not responsible for unauthorized use of a gift card resulting from loss or disclosure of its identifying information, except as otherwise required by law.
19. CUSTOMER ACCOUNTS
Some Services may permit you to create an account.
If you create an account, you are responsible for:
Providing accurate information
Maintaining the confidentiality of your login credentials
Restricting access to your account
Promptly notifying us of suspected unauthorized use

You may access and use the Services for your own personal, noncommercial use.
You may not reproduce, distribute, modify, republish, commercially exploit, or create derivative works from our protected content without our prior written permission, except where applicable law permits otherwise.
22. FEEDBACK AND REVIEWS
We welcome customer feedback.
If you voluntarily provide suggestions, comments, ideas, photographs, testimonials, or other feedback directly to us, you permit us to use that feedback for legitimate business purposes, subject to applicable law and our Privacy Policy.
Nothing in these Terms prohibits you from making an honest statement about your experience with Green Fork & Straw or exercising any consumer right protected by law.
If we wish to use your name, likeness, photograph, or testimonial in advertising in a manner requiring additional permission, we will obtain that permission where required.

WE DO NOT WARRANT THAT THE SERVICES WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.
THIS DISCLAIMER DOES NOT LIMIT WARRANTIES OR CONSUMER RIGHTS THAT CANNOT LAWFULLY BE DISCLAIMED.
Nothing in these Terms eliminates obligations we have regarding the safety, quality, or accurate description of products under applicable law.
26. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE GREEN FORK, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, REPRESENTATIVES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR A CLAIM ARISING FROM A PARTICULAR PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID TO GREEN FORK & STRAW FOR THE PRODUCT OR SERVICE GIVING RISE TO THAT CLAIM.
These limitations do not apply where liability cannot legally be excluded or limited.
Nothing in these Terms is intended to limit liability for fraud, willful misconduct, or any other liability that applicable law prohibits us from limiting.
27. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless The Green Fork, LLC and its officers, owners, employees, and representatives from third-party claims arising directly from your unlawful misuse of the Services or material violation of these Terms.
This provision does not require you to indemnify us for our own negligence, misconduct, or violation of law.
28. EVENTS BEYOND OUR CONTROL
Green Fork & Straw will not be responsible for delay or failure to perform caused by circumstances reasonably beyond our control, including:
Severe weather
Hurricanes
Flooding
Fire
Natural disasters
Power outages
Utility failures
Transportation disruptions
Supply-chain disruptions
Labor disruptions
Government orders
Public-health emergencies
Internet or telecommunications outages
Acts of God
Other similar events
If such an event affects an order, we will make reasonable efforts to communicate with affected customers and provide an appropriate resolution based on the circumstances.
29. PRIVACY
Your use of the Services is also subject to our Privacy Policy, which describes how we collect, use, and disclose personal information.
Our Privacy Policy is incorporated into these Terms by reference.
30. ELECTRONIC COMMUNICATIONS
When you use our Services, place an online order, or communicate with us electronically, you consent to receiving transactional communications electronically where permitted by law.

Delivery notices

Customer service communications
Marketing communications are subject to separate consent and opt-out requirements where applicable.

31. GOVERNING LAW
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Nothing in these Terms deprives a consumer of protections afforded by mandatory laws that apply to them.
32. DISPUTES AND VENUE
We encourage you to contact us first if you have a problem with an order or the Services so we have an opportunity to resolve the issue.
Unless applicable law provides otherwise, any legal proceeding arising from these Terms or use of the Services shall be brought in a court of competent jurisdiction located in Harris County, Texas.
Nothing in this section prevents either party from bringing a matter in an appropriate small claims court or exercising rights that cannot legally be waived.
33. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed if necessary.
The remaining provisions will continue in effect.
34. NO WAIVER
If we do not immediately enforce a provision of these Terms, that does not constitute a waiver of our right to enforce that provision later.
A waiver of one provision or violation does not constitute a waiver of another provision or future violation.
35. ENTIRE AGREEMENT
These Terms, our Privacy Policy, and any additional terms presented in connection with a specific order, catering agreement, promotion, or Service constitute the applicable agreement between you and Green Fork & Straw regarding your use of the Services.
36. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes in our:

Ordering systems

Legal obligations
When we update these Terms, we will revise the “Last Updated” date at the top of this page.
Changes will apply prospectively unless applicable law permits otherwise.
